Arul Health – Terms of Service

Welcome to Arul Health. These Terms of Service ("Terms") explain your rights and responsibilities when using the Arul Health mobile app, website, and clinical therapy services (together, the "Services"). By creating an account, booking a session, or using Arul Health in any way, you agree to these Terms.


1) Who Can Use Arul Health

  • You must be 18 years or older (or the age of majority in your state/country) to use the therapy services. Minors may receive therapy only with verified parental/guardian consent and when permitted by applicable law.

  • By signing up, you represent that you meet these requirements and are legally able to enter into this Agreement.


2) What Arul Health Offers

Arul Health provides two categories of support. App features remain the same; clinical language has been updated for therapy.

a) The Arul Health App (wellness features)

  • An AI companion available via iMessage/SMS for guided emotional check‑ins.

  • A library of guided meditations tailored for cancer‑related stress and healing.

  • A community prompt wall where you can reflect and connect with others.

Important: App features are for wellness and self‑management and are not a medical device and not a substitute for clinical care. SMS/iMessage are not guaranteed to be fully secure; limit sensitive information in unencrypted channels.

b) Arul Health Therapy (licensed clinical services)

  • Evidence‑based telehealth psychotherapy delivered by licensed clinicians (e.g., Psychologists, LCSWs, LMFTs, LPCs, or other licensed professionals depending on jurisdiction).

  • Sessions may include assessment, diagnosis, treatment planning, and psychotherapy interventions appropriate to the clinician’s license and scope of practice.

  • Care is delivered via secure video (and where permitted, phone), in accordance with state/provincial licensure and telehealth laws.

Structure of Care. Therapy is provided by licensed clinicians who practice either as employees/contractors of, or through, Arul Health’s affiliated professional entities (collectively, “Arul Health Therapy”). Arul Health, Inc. provides technology, administration, and patient support. Your clinician—not Arul Health, Inc.—is responsible for clinical judgment and the clinical record.


3) Emergency & Crisis

Arul Health is not for emergencies. If you are in crisis or considering harm to yourself or others, call 911 (U.S.) or your local emergency number immediately, go to the nearest emergency room, or contact a crisis hotline in your region.


4) Medical & Therapeutic Disclaimers

  • App wellness features do not provide medical advice, diagnoses, or mental health treatment.

  • Therapy services are clinical care delivered by licensed clinicians; however, telehealth has limitations and may not be appropriate for every condition or circumstance. Your clinician may refer you to in‑person or higher level of care when needed.

  • Therapy through Arul Health is not suitable for court‑mandated evaluations/treatment, emergency/crisis stabilization, or services that legally require in‑person evaluation unless specifically offered.


5) Eligibility, Location, and Licensure

  • You must be physically located in a jurisdiction where your assigned clinician is licensed at the time of each session. You agree to accurately confirm your location before sessions.

  • Some services may be unavailable in certain regions due to licensure or regulatory limits.


6) Pricing, Subscriptions & Payments

App Access

  • Free access: The Arul Health app and its wellness features are available at no cost. We may offer optional paid add‑ons in the future; if we do, we will disclose pricing before you opt in.

Therapy Sessions

  • Paid 1:1 therapy: Clinical sessions are billed on a per‑session basis (or bundled packages where offered). You will see fees at booking.

  • Insurance: If accepted in your state and for your clinician, we may bill eligible in‑network insurance or provide a superbill for out‑of‑network reimbursement. Coverage and copays vary by plan, and we cannot guarantee reimbursement. You are responsible for all amounts not covered by insurance.

  • Payment timing: Payment (or copay/coinsurance) is due at booking or at time of service, as displayed in the scheduler.

  • Price changes: We may update fees prospectively with notice; you can decline by not booking future sessions.

Cancellations & No‑Shows (Therapy)

  • Standard session length is 45–60 minutes (displayed at booking).

  • Please cancel or reschedule ≥24 hours before the appointment time. Late cancellations or no‑shows may be charged a fee as posted in the scheduler. Repeated late cancellations/no‑shows may lead to discharge from care.

  • If you are late, your session may be shortened to end on time and full fees may still apply.


7) Community Guidelines (App Prompt Wall)

When posting in the app community, you agree to:

  • Be kind, respectful, and non‑discriminatory.

  • Avoid content that is offensive, harmful, misleading, or illegal; no medical or legal misinformation.

  • Not solicit, harass, or advertise.

We may remove content or suspend accounts for violations.


8) Your Account & Communications

  • Keep your login credentials secure and notify us promptly of any unauthorized use.

  • By providing your email/phone, you consent to electronic communications about scheduling, care, and account notices. You can update preferences in the app; some administrative messages are required to deliver services.


9) Privacy & HIPAA

  • Therapy services: Your clinical information is protected under applicable privacy and health laws (e.g., HIPAA in the U.S.). You will receive or be able to view our Notice of Privacy Practices (NPP) describing uses/disclosures of Protected Health Information.

  • App wellness features: App interactions (e.g., AI companion via SMS/iMessage and community posts) are designed for wellness. Avoid sharing highly sensitive health details in unencrypted channels. See our Privacy Policy for details on data practices.


10) Telehealth Consent

By using telehealth, you consent to receive clinical services via secure electronic means, acknowledge the potential benefits and risks (e.g., technology failures, limited nonverbal cues), and agree to verify your physical location as required. You may withdraw consent at any time; however, withdrawing may limit access to services.


11) Clinical Relationship, Fit, and Transitions

  • If the therapeutic fit is not right, you may request a transfer to another clinician (availability varies by licensure and schedules).

  • Clinicians follow professional ethics and may refer, pause, or terminate therapy if it is clinically appropriate, if non‑payment occurs, or if you do not attend sessions. You will receive referrals when care ends.


12) Electronic Communications & Records

  • You consent to electronic records and signatures related to your care and account.

  • Some communications (e.g., reminders) may be sent by SMS/email. Delivery is not guaranteed. Do not rely on SMS/email for urgent issues.


13) Intellectual Property

All meditations, tools, designs, and technology in Arul Health are the property of Arul Health, Inc. and its licensors. You may use them only for personal, non‑commercial purposes. Do not copy, distribute, or reverse engineer our software or content.


14) Third‑Party Content & Services

We may link to or integrate third‑party services (e.g., video platforms, insurers, app stores). We are not responsible for third‑party terms, policies, or performance.


15) Restrictions on Use

You agree not to misuse the Services, including by:

  • Attempting to access other users’ data.

  • Uploading malicious code or violating applicable laws.

  • Sharing medical or legal misinformation in the community.


16) Warranties & Limitation of Liability

  • We aim to provide reliable Services, but they are offered “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

  • To the maximum extent permitted by law, Arul Health’s total liability for any claims arising out of or relating to these Terms or the Services shall not exceed the greater of (i) the amounts you paid to Arul Health for therapy services in the 12 months before the claim, or (ii) $250 for app‑only use.

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

Some jurisdictions do not allow certain limitations; where prohibited, these limits apply to the maximum extent allowed.


17) Indemnification

You agree to defend, indemnify, and hold harmless Arul Health, its affiliates, clinicians (for non‑clinical platform claims), officers, employees, and agents from claims and expenses arising from your misuse of the Services or breach of these Terms.


18) Dispute Resolution; Arbitration; Class Action Waiver (U.S.)

Binding Arbitration. Except for small‑claims or intellectual‑property claims, any dispute arising from or relating to these Terms or the Services will be resolved by final and binding arbitration under the AAA Consumer Arbitration Rules. The seat of arbitration will be Wilmington, Delaware, unless the AAA rules require otherwise. The Federal Arbitration Act governs interpretation and enforcement.

Class Action Waiver. Disputes must be brought individually and not as a class, collective, or representative action. The arbitrator may award relief only to the individual party.

You may opt out of arbitration within 30 days of creating your account by emailing legal@arulhealth.com with subject line: “Arbitration Opt‑Out,” and your name and the email tied to your account.


19) California Consumer & Board Notices

If you receive services within the scope of practice of LMFTs, LCSWs, or LPCCs in California, the Board of Behavioral Sciences receives and responds to complaints: www.bbs.ca.gov or (916) 574‑7830.


20) Export & Sanctions Compliance

You agree not to use the Services in violation of applicable export control or sanctions laws.


21) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the app or email. Your continued use of the Services after the effective date constitutes acceptance.


22) Termination

You may stop using the Services at any time. We may suspend or terminate your account for violations of these Terms, non‑payment, or misuse. Provisions that by their nature should survive termination (e.g., privacy, IP, arbitration, limitations) will continue to apply.


23) Governing Law & Venue

These Terms are governed by the laws of the State of Delaware (without regard to conflict‑of‑laws rules), except where preempted by federal law. Subject to the arbitration clause, the exclusive venue for permissible court actions is state or federal courts in Delaware.


24) Contact Us

25) Practice Policies (Therapy Services)

Appointments & Cancellations

  • Standard live therapy sessions are 45–60 minutes (shown at booking). Requests for longer sessions must be arranged in advance.

  • Cancel/reschedule ≥24 hours in advance to avoid a late cancellation/no‑show fee (as posted at booking).

  • Late arrival may shorten your session; full fees may apply.

Secure Messaging & Accessibility

  • Between‑session contact may be available via secure portal messaging as arranged with your clinician.

  • Clinicians are not always immediately available; they aim to respond within one business day. Do not use messaging for emergencies.

  • Telehealth is preferred; phone may be used when clinically appropriate and permitted by law.

Social Media & Professional Boundaries

  • To protect confidentiality and therapeutic boundaries, clinicians do not accept social media connection requests from clients.

Electronic Communication

  • We cannot guarantee confidentiality for standard email or SMS; limit such use to scheduling/logistics. Use the secure portal for clinical matters when provided.

Termination of Therapy

  • Ending therapy is an important process. Clinicians will not end services abruptly unless required by ethical/legal concerns or repeated non‑attendance/non‑payment.

  • If you do not schedule for three consecutive weeks without prior arrangement, the professional relationship may be considered ended. Referrals will be provided upon termination.

Consent Forms

  • You may be asked to sign additional informed consent forms (e.g., telehealth consent, HIPAA releases, specialty consents) before or during care.


26) Your Content (App)

  • When you share reflections or prompt responses, you grant Arul Health a non‑exclusive, worldwide, royalty‑free license to display and use your content within the Services. We will never use your content in advertising without your permission.


27) Severability; Assignment; Entire Agreement

If any provision is held invalid, the remainder remains in effect. We may assign these Terms; you may not without our consent. These Terms (plus any applicable consents, NPP, and Privacy Policy) constitute the entire agreement between you and Arul Health regarding the Services.
